Insight Terms of Use

Please read this information carefully.

The use of the Insight website by you indicates an acceptance of and agreement to be bound by the terms and conditions contained below. If you do not agree with these terms and conditions do not use the Insight website. If you have any queries in relation to these terms and conditions, we recommend that you seek your own independent legal advice.

 

Disclaimer of Liability

The information contained within Insight’s training materials, including training information, reference to resources and practice examples and supporting materials, is presented for workforce education and training purposes only. The information contained in the education and training materials does not replace, supplement or abrogate professional or clinical judgment and decision making.

While every effort is made to ensure that accurate information is contained within this training package, Insight makes no representation about the content and suitability of this information for any purpose. It is provided "as is" without express or implied warranty. 

 Insight disclaims all warranties with regard to this information, including all implied warranties or merchantability and fitness. In no event shall Insight, its directors, officers, employees, consultants, agents and other representatives be liable for any special indirect or consequential damages or any damages whatsoever resulting from loss of income or profits, whether in an action of contract, negligence or other tortious action, arising in connection with the use or performance of this information. 

 Further, Insight has provided hyperlinks to a number of external videos and sites as a service to our learners. This should not be taken as implying any link between us and those various organisations or individuals. 

 Insight also reserves the right to alter, amend or delete any course, content, admission requirement, mode of delivery or other arrangement without prior notice. 

Users

All users of the Insight website are responsible for their own behaviours including the submission of any data, text or information submitted or uploaded to this website. To the extent necessary, a user that submits any data, text or information provides Insight with a non-exclusive, worldwide, royalty free, irrevocable, sub-licensable, perpetual licence to use such data, text or information on this website. Under no circumstances is any user permitted to include on this website data, text or information which is:

  • misleading or deceptive;
  • false or inaccurate;
  • infringes any person’s copyright, trademark or other proprietary intellectual property;
  • defamatory, threatening, unlawful, obscene, intimidates or racially offensive.

As a user of the Insight website you must ensure that you keep any password provided secure and maintain confidentiality of the password. You must immediately notify Insight if your password has been used without your authority. Insight shall not be responsible for any failure by a user to keep their password secure.

Insight reserves to right at its entire discretion to determine whether a user can use the Insight website or continue to use the Insight website.

Complaints resolution

You agree that in the event you have any complaint associated with services provided by Insight that you will comply with the following complaint process:

  • You will contact Insight forthwith and outline your complaint in writing advising all relevant details.
  • You will allow Insight 30 days in which to respond to your complaint in writing thereafter you will enter into good faith discussions with Insight to resolve such complaint.

In the event that a satisfactory resolution to the complaint cannot be achieved you will enter into mediation with Insight for resolution of the complaint prior to pursuing any legal action to the extent permitted by law.

External websites

The Insight website contains links to a number of other websites. These links are included because they contain content related to alcohol and other drug, mental health and related services. These links are provided to you for information only and you should not construe the link as an endorsement or approval by Insight of that linked website or a recommendation of any third-party products or services. It is the responsibility of the user to make their own decisions or inquiries about the accuracy, completeness, currency, reliability and correctness of information contained in other websites. Users of other websites are responsible for being aware of the organisation hosting the site and noting the terms and conditions of use of the other website, and the copyright and disclaimer conditions. The views or recommendations provided in linked sites do not necessarily reflect those of Insight.

 

Privacy Policy

1.  PURPOSE 

1.1. Insight is an initiative of Queensland Health, delivered by Metro North Mental Health – Alcohol and Drug Service. Insight is responsible for training and educating workers from the alcohol and other drug sector. We are dedicated to ensuring that we comply with our obligations under the Information Privacy Act 2009 (Qld) (‘IP Act’) and the National Privacy Principles (‘NPP’).

1.2.   This Privacy Policy establishes how Insight protects personal information and explains:

1.2.1.    what personal information is collected;

1.2.2.    how Insight uses/discloses that information;

1.2.3.    how Insight stores that information; and

1.2.4.    your entitlement to access personal information.

‘Personal information’ refers to information you have provided to Insight through the website and other digital means.

1.3.   This Policy applies to all personal information collected, stored, used and disclosed by Insight.

1.4.  By accessing Insight, you consent to our collection and use of your personal information in the manner detailed in our Privacy Policy.

2.  WHAT PERSONAL INFORMATION INSIGHT COLLECTS

2.1.   Insight only collects personal information that is relevant to and reasonably necessary for Insight to fulfil its purposes, functions, activities and objectives, including to serve and work with individuals who have registered an account with Insight and /or attend training activities delivered by Insight, employees and other individuals (collectively “you”).

2.2.   Insight will only collect personal information which has been voluntarily provided or consent has been given to the information being collected.

2.3.   The main points at which your personal information may be collected by Insight are:

2.3.1.    on visiting the Insight website;

2.3.2.    when registering for a site account, or event;

2.3.3.    when attending an Insight event in person;

2.3.4.    when attending an Insight event online – for e.g. webinars;

2.3.5.    when an Employee of Insight; and

2.3.6.    when communicating with Insight via phone, email and in-person with staff.

2.4.   The type of information Insight may collect includes, but is not limited to:

2.4.1.    name, address, email address, and other contact details;

2.4.2.    professional registration identification details – for e.g. Royal Australian College of General Practitioners (RACGP), the Australian College of Rural and Remote Medicine (ACCRM) and the Australian Pharmacy Council (APC);

2.4.3.    qualifications, experience, medical training and workplace details;

2.4.4.    details of continuing professional development that has been completed;

2.4.5.    survey / evaluation responses provided by you; and

2.4.6.    results of any examinations, evaluations or forms completed by you on the Insight website.

2.5.   We collect personal information directly from you.

2.6.   When Australian law applies, some information we collect is ‘Personal Information’ (as defined in the IP Act such as memberships of a professional association). Where we collect Personal information, it will only be collected with your consent.

2.7.   The only personal information Insight collects from you via its website is that which you agree to provide, for e.g., when you complete an online form or application for education or registration to attend an event.

3.  HOW INSIGHT USES/DISCLOSES THAT INFORMATION

3.1   Your personal information will not be sold, exchanged, transferred, or given to any other company for any reason without your consent, other than for the purpose of working with you, and providing training and education services to you.

3.2.   Insight has relationships with third parties. In some instances, Insight may disclose your personal information to third parties that we have engaged to provide us with services on your behalf such as assignment of professional credit points (for e.g. Royal Australian College of General Practitioners (RACGP), the Australian College of Rural and Remote Medicine (ACCRM) and the Australian Pharmacy Council (APC)), training and education, event management, payment processing and the preparation of mailings. Wherever possible, these third parties have agreed to treat personal information they receive from us in a confidential manner. 

3.3.  We may disclose your personal information to third parties—including overseas suppliers and service providers—for purposes related to our functions or activities. We take reasonable steps to ensure that overseas recipients do not breach privacy obligations under the IP Act. However, overseas recipients may be required to comply with local legislation instead. In general terms, personal information held by Insight may be used by Insight or disclosed to third parties for one or more of the following purposes:

3.3.1.   training, peer review, assessments, examinations and continuing professional development. This may involve the disclosure of personal information to third parties connected with training, peer review, assessments, examination and continuing professional development such as other Queensland Health services, your place of work and professional entities such as the Royal Australian College of General Practitioners (RACGP), the Australian College of Rural and Remote Medicine (ACCRM) and the Australian Pharmacy Council (APC). 

3.3.2.    in order to assign CPD points;

3.3.3.   inviting you to attend Insight events and/or offering events endorsed or supported by Insight;

3.3.4.  offering member benefits and other services to you, such as Insight’s email newsletter updates. You may request that this information not be sent to you;

3.3.5.  reporting to regulators and government departments in relation to training, peer review, assessments, examination and continuing professional development or as otherwise required by law.

3.4 Insight may also disclose your Personal Information, both within and outside Australia as required or permitted by law. In Australia, this includes disclosure to the following persons in order to enable Insight to comply with the law, enforce our policies, or protect our or others’ rights, property or safety:

3.4.1.    Our professional advisors including lawyers, accountants, tax advisors and auditors;

3.4.2.    Law enforcement bodies to assist in their functions, Courts of law or as otherwise required or authorised by law;

3.4.3.    Regulatory or government bodies for the purposes of resolving customer complaints or disputes both internally and externally or to comply with any investigation by one of these bodies.

4.  HOW INSIGHT STORES AND PROTECTS THAT INFORMATION

4.1.   Insight is committed to ensuring the security of your personal information. Insight is responsible for ensuring that personal information held by us about you is protected by such security safeguards as it is reasonable in the circumstances to take against loss, unauthorised access, modification, disclosure or other misuse of your personal information.

Insight:

  • will maintain all personal information in a secure environment;
  • will not release any personal information except in accordance with the IP Act;
  • will take all reasonable steps to protect personal information from misuse, interference, loss, unauthorised access, modification, or disclosure;
  • will hold personal information in electronic or hard copy form;
  • will destroy or de-identify personal information when it is no longer required; and
  • will take reasonable steps to ensure personal information stored by us is kept accurate, up to date, complete and relevant.

5. THIRD PARTIES

5.1 Google Analytics

We use Google Analytics, a web analytics service provided by Google Inc. ("Google"), to help improve the efficiency and usability of this website.

Google Analytics uses first-party cookies and JavaScript code to gather statistics about how the website is accessed. It anonymously tracks how you interact with this website, including where you came from and what you did on the site. This information (including your IP address) is transmitted to and stored by Google on servers located outside Australia. Google is based in the United States of America (USA). To contact Google, see Google's Contact us page.

Google uses this information to evaluate your use of our website, compile reports on website activity and provide other website and internet usage services. Google may transfer this information to third parties where required to do so by law, or where they process information on Google's behalf.

By using this website, you consent to the processing of data about you by Google in the manner described in Google's Privacy Policy and for the purposes set out above. Relevant legislation of the USA will apply. You can opt out of Google Analytics if you disable or refuse the cookie, disable JavaScript, or use the opt-out service provided by Google.

5.2 HubSpot

We use HubSpot, which provides online tools that can be used to create, send, and manage emails and monitor general enquires. HubSpot may collect personal information, such as distribution lists which contain email addresses, and other information relating to those email addresses. For further information about the type of personal information HubSpot collects, refer to the HubSpot Privacy Policy.

We will only use this information to:

  • create, send and manage emails relating to the work of Insight;
  • manage general enquiries to Insight including request for training, resources and practice advice;
  • measure email campaign performance;
  • improve the features for specific segments of customers;
  • evaluate your use of our website;
  • compile reports on enquiries for strategic planning and resource development;
  • compile reports on website activity for website operators; and
  • provide other services relating to website activity and internet usage.

HubSpot may transfer this information to third parties where required to do so by law, or where such third parties process the information on HubSpot’s behalf. For further information on this, please refer to the HubSpot Data Processing Agreement.

HubSpot has overseas servers. Insight data is stored in the United States of America (USA) East Region servers and the information collected about your use of the website (including your IP address) will be transmitted to and stored by HubSpot on servers located outside Australia.

By creating and account with Insight, you will be taken to have consented to your personal information being used as described above. This means:

  • You consent to your personal information being collected, used, disclosed and stored as set out HubSpot Privacy Policy and agree to abide by HubSpot’s Terms of Use.
  • You understand and acknowledge that this service utilises a cloud-based platform, which is physically located in the United States of America (USA) and relevant legislation of the USA will apply.
  • You understand and acknowledge that HubSpot is not subject to the and you will not be able to seek redress under the IP Act but will need to seek redress under the laws of the USA.
  • You acknowledge that the HubSpot is hosted by data centre partners who maintain independently validated security programs (including SOC 2 and ISO 27001) and that HubSpot systems are regularly tested by independent third-party penetration testing firms. 

5.3 Telstra Integrated Messaging, powered by Soprano Design Limited

We use Soprano Design, which provides us the ability to send SMS reminders for our workshops. Soprano Design may collect personal information about you in connection with the provision of our products and services, including our secure messaging and website products and services. For further information about the type of personal information Soprano may collect, refer to the Soprano Design Privacy Policy.

We will only use this information to:

  • Send SMS reminders for upcoming workshops

Soprano Design implements a number of security measures to protect personal information and to avoid any unauthorised use, modification or disclosure. Soprano Design has operations in Australia, New Zealand, Europe, North America, South America, and Southeast Asia. They may exchange personal information with their representatives, trusted affiliates, regulatory authorities, the Australian Stock Exchange and with our service providers. 

By opting into receiving an SMS reminder for a workshop, you will be taken to have consented to your mobile number you have provided to Insight being used as described above. This means:

  • You consent to your personal information being collected, used, disclosed and stored as set out in Soprano Design Privacy Policy and the Telstra Privacy Policy.
  • You understand and acknowledge that this service utilises a cloud-based platform, which is physically located in Australia and relevant legislation of Australia will apply.
  • You acknowledge that the Telstra store your personal information I storage facilities that are owned and operated by Telstra or are owned and operated by their service providers. 

You can opt out of our SMS reminders through the workshop registration page. This is set up to opt-in at each registration instance and not a standard service.

5.4 Algolia

We use Algolia as a third-party service to enhance our search functionality. Algolia is a search-as-a-service platform that provides fast and relevant search results for our users.

When you use the search feature on our website, Algolia may collect certain data related to your search queries, including but not limited to:

  • Search terms entered
  • Clicked results
  • User interactions with the search results

This information is used to optimize search performance and improve the relevance of search results.

Algolia is committed to protecting user privacy and has its own privacy policy that outlines how they handle data. We encourage users to review Algolia’s privacy policy for more detailed information on their data handling practices. 

Algolia retains search data in accordance with its own data retention policies. We do not have control over how long Algolia retains the information collected through our website. By using our search functionality, you acknowledge and agree to Algolia’s data practices as described in this section.

5.5 Survey Monkey

We use Survey Monkey, a third-party service, to conduct surveys and gather feedback from our learners at workshops. 

When you participate in surveys conducted through Survey Monkey, the information you provide may be collected and processed by Survey Monkey. This data is used to analyse responses and improve our services. The types of data collected may include, but are not limited to, your name, email address, and survey responses.

Survey Monkey has its own privacy policy that governs the handling of your data. We encourage you to review their policy to understand how they collect, use, and protect your information.

Survey Monkey employs various security measures to protect your data. However, please be aware that no data transmission over the internet can be guaranteed to be completely secure.

Data collected through Survey Monkey may be retained in accordance with our data retention policy. This means that your responses will be stored for as long as necessary to fulfill the purposes outlined in this policy or as required by law.

You have the right to access, correct, or delete your personal information. If you wish to exercise these rights concerning your data collected via Survey Monkey, please contact us directly at insight@health.qld.gov.au.

By participating in our surveys through Survey Monkey, you acknowledge that you have read and understood this privacy policy section and consent to the collection and use of your information as described.

6.  ENTITLEMENT TO ACCESS PERSONAL INFORMATION

6.1.   You are entitled to request access to your personal information held by Insight.

6.2.   In normal circumstances Insight will give you full access to your information.

6.3.   However, there may be some legal or administrative reasons to deny access. If Insight decides to deny access, Insight will provide a reason why this is the case.

6.4 You are entitled to request the correction of any personal information, and if there is a reasonable basis for declining the correction request, you are entitled to request that a statement of correction sought but not made be attached to the information.

6.5. If you would like to access your personal information or if you believe that your personal information may be inaccurate, out of date or incomplete, you can sign into your own account to make these corrections or make a request by sending an email to insight@health.qld.gov.au. 

7.  KEEPING INFORMATION ACCURATE AND UP TO DATE

7.1.   Insight makes every reasonable effort to keep your information accurate, up to date and complete, in order to provide the best possible service to you.  You can assist by keeping Insight informed of any updates such as address change, email change or legal name change. You can do this by signing into your account online or emailing insight@health.qld.gov.au

8.  REPORTING A BREACH OF YOUR PRIVACY

8.1.   If you have any concerns that your privacy has been compromised or have any other privacy related complaint, please email insight@health.qld.gov.au and we will contact you within 10 business days to confirm receipt of your email. We will then investigate your complaint and provide you with our response within a reasonable time. If after receiving our response, you still consider that your privacy complaint remains unresolved, you may then, for example, take your complaint to the Queensland Office of the Information Commissioner.

9.  CHANGES TO OUR PRIVACY POLICY

9.1.   We reserve the right to modify this Privacy Policy at any time by posting changes on this Privacy page.

 

General Terms

Insight shall not be liable for any failure by it to perform this Agreement, or for any loss and damage suffered by you in consequence thereof which failure arises from any cause whatsoever beyond the control of Insight including (but not being limited to) computer, communication or network failures, fire or other accident, strikes or other labour disputes, any computer virus introduced by a third party, or any other law, proclamation, regulation or ordinance or any government agency. 

If you breach these User Terms and Conditions, Insight may suspend, terminate or limit your access to this website. If Insight does not act in relation to a breach by you of these terms and conditions, this does not waive Insight’s right to act with respect to subsequent or similar breaches.

This Agreement shall be governed by and construed in accordance with the laws in force in Queensland and all disputes arising in connection with this Agreement shall be submitted to the jurisdiction of the relevant court of Queensland. 

This Agreement constitutes the entire agreement of the parties with respect to the subject matter hereof and supersedes all previous written or oral agreement between the parties with respect to such subject matter.
